Fountain Valley, CA Cannabis Regulations: Dispensary Zoning (2026)

Fountain Valley handles cannabis through two chapters of the Municipal Code, both adopted by the City Council as outright prohibitions. Chapter 8.60 (Ordinance 1508, 2015) covers medical cannabis. Section 8.60.020 prohibits commercial cannabis activity of all types, cultivation by anyone including a qualified patient or primary caregiver, delivery that starts or ends in the city, dispensing, and cannabis dispensaries. No person can own, manage, operate or work in a dispensary, whether as an employee or independent contractor.

Chapter 8.61 (Ordinance 1526, 2017) covers non-medical marijuana. Section 8.61.030 prohibits non-medical commercial marijuana activity of every type, listing cultivation, possession, manufacture, distribution, processing, storing, laboratory testing, labeling, transportation, delivery and sale. No person can own, operate, manage, conduct or work in a non-medical commercial marijuana business or facility. Subsection (c) prohibits establishing or operating any business type licensed under Division 10 of the California Business and Professions Code, which starts at Section 26000.

Two carve-outs appear in Chapter 8.60. A qualified patient or person with an identification card can bring medical cannabis into the city for personal use, and a designated primary caregiver can bring it in for the patient. Section 8.61.040 also allows personal non-medical cultivation, but only inside a private residence or a fully enclosed and secure accessory structure on the grounds of a private residence, limited to six live plants at any one time. Outdoor planting, cultivating, harvesting, drying or processing is prohibited.

Because the bans are written as citywide prohibitions on activity, Fountain Valley has no permit path or zoning overlay for a dispensary, and the definitions incorporate Business and Professions Code Sections 19300.5 and 26001 as amended.
