Oak Park, IL Cannabis Regulations: Dispensary Zoning (2026)

Oak Park Village Code Chapter 8, Article 39 regulates adult-use cannabis business establishments, including craft growers, cultivation centers, dispensing organizations, infusers, processors and transporters. Section 8-39-2 requires every cannabis business establishment to apply for and obtain a Village business registration certificate before operating, and section 8-39-3(B) bars any cannabis establishment or craft grower from operating without first receiving all required approvals, including from the Illinois Department of Financial and Professional Regulation and the Illinois Department of Agriculture as applicable. Section 8-39-4 lists the application's minimum requirements, which for siting purposes include, under subsections I and J, a copy of the special use permit issued by the Village Board and a copy of the site plan as submitted to the Zoning Board of Appeals or other applicable public body; in practice this means Village approval of where a cannabis business establishment may locate runs through the special use permit and site plan process rather than through a list of by-right zoning districts in this Code.

There is no registration fee under section 8-39-6, but registration is non-transferable under section 8-39-3(E), meaning a permit cannot follow the business to a new address, a new classification or a new owner. Operation requirements in section 8-39-11 further shape where and how a registered establishment can function: all activity must occur indoors and out of ordinary public view, deliveries must use a secured, enclosed unloading space, and product cannot be visible from outside the premises. Registered establishments consent to Village inspection under sections 8-39-3(C) and 8-39-10.
