Summary

Plantation prohibits Medical Marijuana Treatment Center dispensing facilities anywhere within city limits. City Code § 27-112(b) invokes the municipality's authority under F.S. § 381.986(11) to ban dispensaries outright rather than zone them into specific districts.

Sec. 27-112. - Medical Marijuana. (a)Definitions. As used in this article, the following terms shall have the respective meanings ascribed to them: Medical Marijuana Treatment Center Dispensing Facilities means any dispensing facility, as defined by Fla. Admin. Code r. 64-4.001, as amended, with all applicable regulations, or any other similar facility or operation, of an approved Medical Marijuana Treatment Center authorized to operate in Florida under Art. X, § 29 of the Florida Constitution, § 381.986, Florida Statutes, as amended. (b)Prohibition Concerning Medical Marijuana.(1)Purpose. It is the purpose of this ordinance to prohibit Medical Marijuana Treatment Centers created under Art. X, § 29 of the Florida Constitution from establishing Medical Marijuana Treatment Center Dispensing Facilities within the municipal limits of the City of Plantation;(2)Findings. Based on authority granted to municipalities in Section 381.986(11) Florida Statutes, the City Council finds that a ban on the establishment of Medical Marijuana Treatment Center Dispensaries within the City of Plantation is in the best interest of the City;(3)Medical Marijuana Treatment Center Dispensing Facilities are prohibited within the boundaries of the City of Plantation.

Full Breakdown

Section 27-112 defines a Medical Marijuana Treatment Center Dispensing Facility by reference to the state's regulatory definition in Florida Administrative Code r. 986. 986(11). The operative text of § 27-112(b)(3) states plainly that dispensing facilities are prohibited within the boundaries of the City of Plantation, with no exception carved out for any zoning district, overlay, or conditional-use pathway. This means there is no application process, distance requirement, or permitted-use table entry for a dispensary anywhere in Plantation; the use is barred by definition before a zoning review would even begin.

The prohibition applies specifically to dispensing facilities themselves and does not by its terms reach other medical marijuana-adjacent uses, which are regulated, if at all, under different code provisions.

Violations & Fines

Because § 27-112(b)(3) bars the use outright, a Medical Marijuana Treatment Center Dispensing Facility cannot be approved through any zoning, site plan, or conditional-use process in Plantation; an application would be denied as a prohibited use rather than cited after the fact. An operator that opened despite the ban would face the city's standard zoning enforcement track under Chapter 6, including a notice of violation and referral to the Special Magistrate.

Frequently Asked Questions

Can a medical marijuana dispensary open in Plantation?
No. City Code § 27-112(b)(3) prohibits Medical Marijuana Treatment Center Dispensing Facilities anywhere within Plantation's city limits. Unlike cities that zone dispensaries into commercial corridors with distance buffers, Plantation opted to ban the use entirely under the authority Florida gave municipalities in F.S. § 381.986(11).
Why doesn't Plantation just restrict dispensaries to certain zoning districts instead of banning them?
The City Council made an explicit finding under § 27-112(b)(2) that a total ban, not a zoning-based restriction, was in the best interest of the city, using the local opt-out power granted under F.S. § 381.986(11) rather than the conditional-use or overlay approach some neighboring municipalities use.
Does the Plantation dispensary ban affect medical marijuana patients themselves?
No. Section 27-112 only bars the establishment of dispensing facilities within city limits; it does not regulate patients' ability to possess or use medical marijuana under their state-issued qualification, which remains governed entirely by Florida's Article X, Section 29 medical marijuana program.
