Sec. 27-112. - Medical Marijuana. (a)Definitions. As used in this article, the following terms shall have the respective meanings ascribed to them: Medical Marijuana Treatment Center Dispensing Facilities means any dispensing facility, as defined by Fla. Code r. 64-4.001, as amended, with all applicable regulations, or any other similar facility or operation, of an approved Medical Marijuana Treatment Center authorized to operate in Florida under Art. X, § 29 of the Florida Constitution, § 381.986, Florida Statutes, as amended. (b)Prohibition Concerning Medical Marijuana.(1)Purpose. It is the purpose of this ordinance to prohibit Medical Marijuana Treatment Centers created under Art. X, § 29 of the Florida Constitution from establishing Medical Marijuana Treatment Center Dispensing Facilities within the municipal limits of the City of Plantation;(2)Findings. Based on authority granted to municipalities in Section 381.986(11) Florida Statutes, the City Council finds that a ban on the establishment of Medical Marijuana Treatment Center Dispensaries within the City of Plantation is in the best interest of the City;(3)Medical Marijuana Treatment Center Dispensing Facilities are prohibited within the boundaries of the City of Plantation.
