Prescott Valley, AZ Cannabis Regulations: Dispensary Zoning (2026)

The Town Council rewrote the marijuana rules as § 13-08-040 of the Prescott Valley Town Code through Ordinance No 2024-947 on 12/11/2024, and Ordinance No. 2025-962 amended the section on 10/09/25. The Code defines a dual marijuana establishment as a combined nonprofit medical marijuana dispensary and marijuana establishment in a shared location and operated by a dual licensee. A dual licensee qualifies only if it has not forfeited or terminated its nonprofit medical marijuana dispensary registration from the Arizona Department of Health Services.

Even in the five allowed zones, the dual establishment carries a long list of operating conditions. It must comply with § 13-11-070 on nuisances and hazards, keep the name and location of any associated cultivation facility on file with the Town, and offer no drive-through service. It must operate from a permanent building on an established foundation, never from a trailer, cargo container, motor vehicle or other portable facility. Permitted hours of operation run from 7:00 am to 10:00 pm. Outdoor seating areas are not allowed, consumption on the premises is prohibited, and no marijuana or paraphernalia can be visible from outside. The operator must also submit a written security plan to the Prescott Valley Police Department covering entrance control, security equipment and electronic monitoring, and exterior lighting.

Other marijuana uses are narrower still. Dual establishments with onsite cultivation or infusion are limited to the CI, PM, IG and IH zones, and standalone cultivation facilities are permitted in those same four zones. Marijuana testing facilities, cultivation locations and manufacturing locations that cannot sell to consumers are prohibited to the fullest extent Arizona law allows. Cultivation is prohibited in any residential zoning district. Every permitted site also faces the separate 500-foot location restrictions, which are covered on the buffer-zone page for the Town.
