Marijuana cultivation facilities face a parallel 500-foot rule under Town Code § 13-08-040.

(f) A place of worship, public park, public building, college, licensed drug or alcohol rehabilitation facility, correctional transitional housing facility, or public community center. Full Breakdown
The buffer rules sit inside § 13-08-040(C) of the Prescott Valley Town Code, which the Town Council rewrote by Ordinance No 2024-947 on 12/11/2024 and amended by Ordinance No. 2025-962 on 10/09/25. They apply on top of the zone limits: a dual marijuana establishment is permitted only in the CG, CI, PM, IG and IH zones, so a lot has to pass both the zoning test and the distance test.
For a dual marijuana establishment, the 500-foot radius runs from the establishment to six categories: another dual marijuana establishment; a nonprofit medical marijuana dispensary or marijuana establishment; a marijuana cultivation facility; the nearest zone boundary of the RU, RL, RM, MH, MF and RS zoning districts; a public or private preschool, kindergarten, elementary school, secondary school or high school; and a place of worship, public park, public building, college, licensed drug or alcohol rehabilitation facility, correctional transitional housing facility, or public community center.
The Code also fixes how the distance is measured, which matters on a tight lot. For a dual marijuana establishment the measurement is the shortest horizontal line from the nearest exterior wall of the establishment building to the property line of the other use. For a marijuana cultivation facility the line runs from the property line of the cultivation facility to the property line of the other use, and the facility's own 500-foot list covers another cultivation facility, any dispensary, marijuana establishment or dual establishment, the same residential zone boundaries, schools, and the same group of places of worship, parks and public buildings.
Because the residential test is measured to the zone boundary rather than to a house, a site near the edge of a residential district can fail even when no home is close by.
Violations & Fines
Section 13-08-040 prints no separate penalty, so Town Code § 1-08-010 supplies it. A violation is a class 1 misdemeanor, with each day a separate offense. A Code violation is also a civil offense with a civil sanction not to exceed $2,500, and each day that a violation continues counts separately.
