Tamarac, FL Cannabis Regulations: Dispensary Zoning (2026)

Tamarac's Land Development Code treats a medical marijuana dispensary as a Retail use type under LDC § 10-3.3(D)(15)(d), Use-Specific Standards, and layers three restrictions onto any district where the use is otherwise permitted. First, a dispensary cannot locate within five hundred (500) feet of the real property of a public or private elementary, middle, or secondary school, measured from the dispensary's property line to the nearest point of the school's property line, unless the city approves the location through a formal variance proceeding open to the public where it finds the location promotes public health, safety, and general welfare.

Second, no dispensary may dispense marijuana or a marijuana delivery device from its premises between 9:00 p.m. and 7:00 a.m., a curfew tighter than the retail hours most shopping-center tenants keep. Third, every dispensary offering retail services in the city must be duly licensed by the State of Florida under F.S. § 381.986 and must operate, provide security, and post signage consistent with that state statute as amended; the Code also requires a City business license for each location, assessed at the same fee rate the city charges pharmacies rather than a bespoke cannabis fee.

These standards apply on top of, not instead of, whatever base zoning district permissions the LDC's use table sets for retail medical marijuana dispensaries, so a proposed location still has to clear the underlying district's use allowance before the school-distance and hours limits come into play.
