Plants must be in an enclosed and locked area such as a garage, locked greenhouse, or interior room. The cultivation site cannot be visible from public view, including from streets, sidewalks, or neighboring lots. Tucson does not impose a stricter local cap, but landlords may prohibit cultivation through lease terms. The state allows possession of up to one ounce of usable flower for personal use.
Plants visible from public space are a petty offense for first violations. Exceeding twelve per household, sale, or unlocked cultivation can be charged as misdemeanors or felonies under ARS Title 13.
