Tucson UDC Β§4.9.13 requires marijuana retail and cultivation establishments to maintain a minimum 200-foot buffer from public and private schools, measured property line to property line, in addition to state-mandated separations.
After Arizona Proposition 207 (2020) legalized adult-use cannabis, Tucson updated the Unified Development Code to add Β§4.9.13 zoning controls. Marijuana establishments are permitted only in commercial and industrial zones and must keep at least 200 feet from any public or private school site. The city also reads the UDC to require separation from public parks and certain residential edges. Distances are measured property line to property line by the shortest pedestrian route on a public way. State law adds further restrictions through ARS Title 36 Ch. 28.2 and Arizona Department of Health Services rules in A.A.C. Title 9 Ch. 18.
Operating without zoning compliance triggers UDC enforcement, potential certificate-of-occupancy revocation, and ADHS license action. New school construction does not retroactively close existing dispensaries.
