Under Town Code § 109-12, the Code Enforcement Officer is required to review and investigate any complaint alleging a condition or activity that fails to comply with the Uniform Code, the Energy Code, Chapter 109, or any other local law adopted for their administration. The code lays out the process the officer follows once a complaint comes in: first, inspecting the conditions or activities alleged to be in violation and documenting the results; second, if a violation is confirmed, notifying the property owner (and anyone else responsible) of the violation with an opportunity to abate, correct, or cure it, or proceeding under the penalty provisions of § 109-18; third, issuing a stop-work order where appropriate; and fourth, once the violation is fixed, performing a follow-up inspection, preparing a final written report documenting the correction, and filing that report with the original complaint.

If the officer instead issues a formal order to remedy under § 109-18(A), that order must be in writing, dated, signed, specify the violating condition and the exact code provision violated, and give the violator 30 days to fully remedy it, with service made on the owner personally or by certified mail within five days. Penalties for confirmed violations run up to $2,500 per day for a first offense, escalating to $2,500-$5,000 for a second offense within 18 months, $7,500-$10,000 for a third, and $10,000-$15,000 for a fourth or subsequent offense, plus possible imprisonment of up to 15 days.

The Town may also pursue a civil penalty of up to $2,500 per day under § 109-18(C)(2) and injunctive relief through the Supreme Court under § 109-18(D) with Town Board authorization.
