Clarkstown, NY Parking Rules: Loading Zones (2026)

Clarkstown regulates commercial loading in two layers. Inside the New City Hamlet Center's H1, H3 and H4 Districts (loading docks are not a permitted accessory use in H2), § 290-7.5G(4)(d) treats the loading dock as a specific performance standard: only one bay or dock is allowed per building, it may operate only between 7:00 a.m. and 7:00 p.m., and it must be adequately screened from view, though the Planning Board can modify those terms case by case during site plan review.

Outside the Hamlet Center, the Town's general loading standards in §§ 290-23 through 290-26 apply to any nonresidential use required to provide off-street loading under Column 7 of the Use Tables. Section 290-25B fixes minimum dimensions: a loading berth must be at least 12 feet wide, 33 feet long and 14 feet high, and a loading area at least 12 by 20 feet, located either inside a building or in open space that does not overlap required parking or its access drives. Open loading berths are barred from front and side yards and from sitting next to a residential district or by-right residential use, and any open loading area must keep a screened 50-foot setback from every property line under § 290-25D. Enclosed loading berths get a smaller 25-foot property-line setback under § 290-25E, provided they avoid the front yard. Section 290-25F requires indirect lighting on every loading berth, loading area and connecting driveway, and limits vehicle access to roads classified as major or secondary on the Town's Official Map, keeping truck traffic off local streets. Section 290-26A separately bars any loading berth entrance or exit within 50 feet of a street intersection, and § 290-26B requires screening wherever a loading berth sits within 50 feet of a residential district.
