A building permit is required to install any in-ground or above-ground swimming pool or spa in the City of Baton Rouge / East Baton Rouge Parish. From first excavation until the permanent barrier is finished, the site must be enclosed with construction fencing at least 4 feet high.
ISPSC Sec. 305.1.1 (adopted City-Parish)
The construction sites for in-ground swimming pools and spas shall be provided with construction fencing to surround the site from the time that any excavation occurs up to the time that the permanent barrier is completed. The fencing shall be not less than 4 feet in height.
Every residential pool or spa must be enclosed by a barrier at least 48 inches above grade. Gaps under the barrier may not exceed 2 inches, and openings must be too small to pass a 4-inch sphere. Pedestrian gates must open outward, self-close, and self-latch.
ISPSC Sec. 305.2.1-305.2.2 (adopted City-Parish)
The top of the barrier shall be at least 48 inches above grade. The maximum vertical clearance between grade and the bottom of the barrier shall be 2 inches. Openings in the barrier shall not allow the passage of a 4-inch sphere.
Where a house wall forms part of the pool barrier, doors and low windows with direct pool access must have a listed water-hazard alarm, an ASTM F1346 safety cover, or self-closing/self-latching protection. Public (Class A/B) pools separately need barriers meeting the state Sanitary Code.

Class A or Class B public swimming pools shall be protected by a fence, wall, building, enclosure, or solid wall of durable material... [Barriers shall] afford no external handholds or footholds, be at least 4 feet in height, and be equipped with a self-closing and positive self-latching closure mechanism at a height of at least 45 inches above the ground.
An above-ground pool wall can serve as the barrier only if its top is at least 48 inches above grade around the whole perimeter and the wall meets the fence standards. Ladders or steps must be lockable, removable, or surrounded by a compliant barrier.

Where only the pool wall serves as the barrier, the bottom of the wall is on grade, the top of the wall is not less than 48 inches above grade for the entire perimeter of the pool, the wall complies with the requirements of Section 305.2 and the pool manufacturer allows the wall to serve as a barrier.
