Obstruction Rules

Hamilton County bars anyone from pushing snow, debris, construction materials, litter or any other item onto a county road right-of-way under Sec. 8-20-8-6(a). A vehicle blocking that right-of-way can be towed at the owner's expense, and violating this section is an infraction punishable by a fine of up to $2,500.00.

Encroachment Permits

Anyone who wants to build, dig, install a driveway, or store items within a Hamilton County road right-of-way must get a permit first. Sec. 8-17-4-2 requires county commissioner approval and a Highway Department application before construction, utility work, or any private use of county right-of-way begins, with a published fee schedule covering each type of work.
