Hayward Municipal Code prohibits minors under 18 from being in public places without a parent between 10 p.m. and 5 a.m., with several specific exceptions.
Hayward Municipal Code Chapter 4 establishes a juvenile curfew that makes it unlawful for minors under the age of 18 to loiter, wander, or remain in public places or on the premises of a public establishment between 10 p.m. and 5 a.m. Exceptions include being accompanied by a parent, legal guardian, or other adult with parental consent; traveling directly to or from lawful employment; going to or from a school, religious, or civic event sponsored by a recognized organization; attending to an emergency; or exercising First Amendment rights such as attending political or religious activities. Parents and guardians who knowingly permit a violation may also be cited. Hayward Police Department officers may detain minors found violating the curfew, contact parents, and release to them, with referral to diversion programs or, for repeat offenders, issuance of an infraction citation. Curfew applies citywide, including parks, shopping centers, and transit stops.
