Hayward Municipal Code Sec. 10 states "no person shall enter upon or otherwise remain within any City park between the hours of sunset and sunrise of the following day or for the period specifically posted as closure hours at the entrance to the particular park," unless the person is using a sidewalk, pathway, or right-of-way to reach an authorized event, an open public facility inside the park, adjacent private property with an entry point next to the path, or an adjacent public transit stop during service hours.
Sec. 00 defines "City Park" to mean Portuguese Park, Giuliani Plaza, Newman Park, Library Park, City Hall Plaza (including its pathways, green space and rights-of-way bounded by B Street, Watkins Street, Montgomery Avenue and the City Walk Condominiums), and any other city-owned park or open space not managed by the Hayward Area Recreation and Park District (HARD). Because HARD independently manages many of Hayward's neighborhood parks and playgrounds, this ordinance only reaches parks under direct City control; Sec. 10(a) expressly exempts the Children's Playground at Giuliani Plaza because HARD regulates it.
The ordinance, adopted by Ordinance 13-10 on November 5, 2013, was written to address after-hours loitering and safety concerns at City-run open spaces separate from HARD's park system.
