Kauai County, HI Curfew Laws: Juvenile Curfew (2026)

Section 22-1.3(a) makes it unlawful for anyone under 18 to be walking, running, loitering, playing or motoring on any public street, highway, road, alley, public place, dock, wharf, vacant premises or other unsupervised area within the County between 10:00 p.m. and 6:00 a.m. Sunday through Thursday nights, and between midnight and 6:00 a.m. on Friday and Saturday nights. The Council found in § 22-1.1 that regulating juveniles' presence in public at night protects the health, safety, welfare and morals of Kaua'i's youth and the peace of the island.

The curfew does not apply to a minor accompanied by a parent, guardian or another adult given custody by the parent, or to a minor on an emergency errand, traveling to or from a bona fide school or recognized club function, or at work when the job requires being out during curfew hours. Section 22-1.4 separately makes it unlawful for a parent, guardian or other adult with custody of a minor to knowingly let that minor break curfew, with the same exceptions. Any police officer on duty may detain a minor caught violating § 22-1.3 under § 22-1.5, holding the minor until a parent or guardian takes custody, and the officer must contact the parent or guardian immediately after taking the minor into custody.

Under the penalty at § 22-1.6, a minor convicted of a curfew violation is handled through Family Court law and procedure rather than a fine, while a parent or guardian who knowingly or negligently let the minor break curfew is fined up to $100 for each offense of the minor. Each violation of §§ 22-1.3 and 22-1.4 counts as a separate offense.
