Summary

(1)Time limits for minors. It is unlawful for any juvenile under the age of 16 years to be or remain upon any establishment or public place in the county between 11:00 p.m. on Sunday, Monday, Tuesday, Wednesday, Thursday, Friday, or Saturday and 6:00 a.m. of the following day.

County Code Sec. 5-123 sets three curfew windows. m. m. Monday through Friday. the following day, every day of the week. on a school day unless with a parent or guardian. A parent or guardian who knowingly permits, or through insufficient control allows, a juvenile or minor to remain out during restricted hours commits a separate offense, and "knowingly" is judged by an objective reasonable-parent standard, not by claimed indifference. An establishment's owner, operator, or employee who knowingly allows a minor to remain during restricted hours is likewise liable, using the same objective test.
Sec. at a parent's direction, interstate travel, lawful employment, emergencies, supervised school or religious activities, First Amendment activity, and marriage or emancipation. A sheriff-issued special permit is also available by written application, appealable to a district court judge within 30 days of denial.
Violations & Fines
A juvenile who violates the curfew is subject to being adjudicated delinquent under the North Carolina Juvenile Code rather than fined directly, per Sec. 9.5-127(a). Any other person, including a parent, guardian, or establishment operator, who violates the article is guilty of a misdemeanor punishable by a fine up to $100.00 and imprisonment in the court's discretion under G.S. 14-4, per Sec. 9.5-127(b). Officers must first ask the person's age and reason for being out under Sec. 9.5-126 before issuing a citation or arrest.
