Under Alameda Municipal Code Chapter XXIII (Parks), it is unlawful to be present in any park except during hours it is open to the public. The Recreation and Park Commission sets each park's hours by resolution and posts closing signs. It is separately unlawful to be on the pier/deck east of the Miller-Sweeney Bridge between 9:00 p.m. and 7:00 a.m.
Alameda's park rules appear in Municipal Code Chapter XXIII (Parks, Recreation Areas and Public Property). The code provides that it shall be unlawful for any person to be present in any park except during such hours as the park is open to the public. Rather than fixing a single citywide curfew time in the code, the ordinance delegates that authority: the Recreation and Park Commission shall by resolution establish the times during which each park is open to the public and shall post signs conspicuously giving notice of those times and of the closing hour. The Commission may exempt regularly scheduled Recreation and Park Department activities or groups specifically authorized by the Department from the closing time. A specific time-based restriction does appear in the code: it is unlawful for any person to be present on the pier, deck, or platform and entryway east of the Miller-Sweeney Bridge between the hours of 9:00 p.m. and 7:00 a.m. The chapter also makes it unlawful to operate or park a motor vehicle in a city park or public beach, to ride bicycles/skateboards where posted (with a Skate Park exception requiring helmets and pads), and to possess or consume alcoholic beverages in the outdoor areas of any city park. Because exact open/close hours are set by Commission resolution and posted on park signage, check the posted hours at each park.
Being present in a park after its posted closing hour, or on the Miller-Sweeney Bridge pier/deck between 9:00 p.m. and 7:00 a.m., is unlawful and can result in citation. Driving/parking in a park, or possessing alcohol in outdoor park areas, are separately prohibited.
