Sec. 70-68(a) sets the baseline: except for unusual and unforeseen emergencies, parks stay open to the public every day of the year during hours the city posts individually at each park. Subsection (b) then closes every city park during the hours of darkness, with one carve-out: recreational areas that are fully lit by artificial lighting for public attendance or participation in a sports activity the superintendent has approved may stay open into the dark. Subsection (c) requires the city to post legible signs at every main entrance and exit and at regular intervals along park boundaries reading 'Closed to the Public During Hours of Darkness, Violators Will Be Prosecuted,' or words of similar import, so the closure is posted rather than left to guesswork.

Enforcement runs through Sec. 70-69: the superintendent of parks and recreation, park attendants, and police can order anyone found in a closed park after dark to leave immediately, and refusal to leave exposes the person to arrest for criminal trespass in addition to the underlying curfew violation. Because Chapter 70 does not set a specific fine for the after-dark closure itself, a citation for being in a park during closed hours falls under the Code's general penalty at Sec. 1-9, punishable by a fine of not more than $500.00, imprisonment of not more than 60 days, or both, with each day of a continuing violation treated as a separate offense.
