Clarkstown, NY Curfew Laws: Park Curfew (2026)

Section 202-8 of the Parks and Recreation Facilities chapter fixes the daily window a Town of Clarkstown park may be used: from dawn until one hour after sunset. Anyone who loiters or remains in a park before dawn or after that hour is violating the section unless the Superintendent of Recreation and Parks has granted special permission in advance, something the code leaves entirely to the Superintendent's discretion and does not define by any written standard. The rule sits inside a broader park-conduct scheme: § 202-1 already limits park use to Town of Clarkstown residents and their guests (except at the Charles B.

Davenport Preserve), and § 202-2 through § 202-19 add separate bans on damaging park property, dumping refuse, unpermitted fires, possessing alcohol, unleashed dogs outside the Congers Lake dog park, firearms, unauthorized business activity and unpermitted advertising. Penalties for any violation of Chapter 202, including the after-hours closing, are set out in § 202-21: a fine of up to $1,000 for a first offense, $2,500 to $5,000 for a second offense within 18 months, and $5,000 to $7,500 for a third within 18 months, on top of loss of park privileges, and each continuing day of violation counts as a separate offense.

Enforcement is delegated under § 202-22 to the Superintendent of Recreation and Parks, that office's designees, the Clarkstown Police Department and the Town's Code Enforcement personnel. This rule governs Town-run parks in the unincorporated Town only; the Villages of Nyack, Upper Nyack and South Nyack run their own separate parks systems under their own local laws.
