Fauquier County, VA Curfew Laws: Park Curfew (2026)

Section 16-2 gives the director of parks and recreation authority to set the hours any county park is open to the public, and those hours must be posted prominently at the park entrance. Once posted, it is unlawful for any person to be present in the park during hours it is not open, with three narrow exceptions: county employees or agents conducting official business, participants or spectators in a county-sponsored activity that runs past posted closing, and holders of a valid permit issued under § 16-3 for an event extending beyond posted hours.

Section 16-1(c) makes clear that any violation of the parks chapter, including the hours rule, is punishable as provided in § 16-9. The parks and recreation director and county deputy sheriffs patrol and enforce park hours, and the director may also waive the hours rule for training or education conducted by a public or private civic, educational, law enforcement or safety agency under § 16-10. Because § 16-2 covers every county-operated park, from small community parks to larger recreation areas, the posted sign at each entrance is the controlling document for what counts as after-hours presence at that specific site.
