Sec. 28-14(x), titled "Loitering," bars anyone from loitering or remaining "in any public park at any time between time posted for closing at night and daylight of the following morning," and states plainly that "Parks are open daily from dawn to dusk." The rule sits within the same general park-conduct section, Sec. 28-14, that opens by declaring unlawful any of the listed acts "within the limits of any park, recreation area, or facility within the city of Salinas."

The curfew is backed up by a related parking rule: Sec. 28-14(n) states that parking lots are open only during park and recreation facility operating hours, and any vehicle left in a lot after hours is "subject to towing at the owners' expense." The recreation-park commission can adopt and post additional rules for individual parks, including specific closing times, under Sec. 28-13, and those posted rules are enforceable once conspicuously displayed at the site. Anyone in a Salinas park after the posted closing time and before daylight, without an exception such as the Sherwood Rodeo Regional Recreation Area's twenty-four-hour recreational-vehicle camping allowance under Sec. 28-14(h)(2), is in violation. Violating Sec. 28-14 is an infraction under Sec. 28-15, and a person disciplined for it can appeal to the recreation-park commission under Sec. 28-12.
