Smithtown, NY Curfew Laws: Park Curfew (2026)

Section 101-19, 'Closing of parks and beaches,' has two parts. Subsection A, amended 3-22-1994, authorizes the Town Parks Maintenance Director to close any section or part of any park or beach entirely or merely to certain uses, for any interval of time, either temporarily or at regular and stated intervals, giving the Director broad day-to-day authority to shut gates, close a lot for maintenance, or restrict a beach to certain uses. Subsection B sets the Town-wide park curfew: no person shall enter or remain in any park or beach more than half an hour after sunset, and no person shall park a motor vehicle at any park or beach more than half an hour after sunset, except as the camper, boater and permitted-fisherman exception in Section 101-6F allows.

Read together, the two subsections mean every Smithtown park and beach effectively closes thirty minutes past sundown every night unless a Director's order sets an earlier closing, and the only people who may lawfully remain past that half-hour mark are permit holders actively engaged in overnight camping, boating or fishing under Section 101-6F.
