Sec. 112-8 requires any person, firm, corporation, business, or legal entity proposing to clear, grade, excavate, or otherwise disturb one acre or more of total land area for construction purposes to prepare and submit a SWPPP to the city engineer for review and obtain a grading permit before commencing the land disturbance. The one-acre threshold also captures smaller sites that are part of a larger common development or sale where the overall plan will ultimately disturb an acre or more, closing the obvious loophole of phasing a project into sub-acre parcels.

Sec. 112-11(b)(3) places an ongoing duty on developers to provide, install, and maintain appropriate erosion control measures and other stormwater best management practices, both during and after construction, to minimize adverse impacts to water quality or the local environment. Sec. 112-43(a)(2)(a) requires the city engineer to inspect the site prior to the initiation of the project, specifically to confirm temporary or permanent erosion prevention and sediment control practices have been installed, and again after rough grading and upon project completion. Compliance with a valid NPDES construction permit is treated as compliance with the local SWPPP requirement under Sec. 112-12(g), tying the local erosion rule directly to the state/federal permit.
