Chapter 1349, Erosion and Sediment Control, is Medina's separate construction-phase companion to the Chapter 1347 stormwater code. 01 applies the regulation to parcels developed for highways, underground cables or pipelines, subdivisions, industrial, commercial, institutional or residential projects, farm building activities and general clearing, exempting only activities covered by the Ohio Agricultural Sediment Pollution Abatement Rules. 12(c) bars any covered project from starting without an approved SWP3 or Abbreviated SWP3. 13 lets the City of Medina and the Medina County Soil and Water Conservation District issue immediate stop-work orders and conduct external inspections.
13(e) sets a graduated penalty scale for failing to maintain erosion controls: a first violation draws a Notice of Deficiency with three days to correct; a second violation adds a $500 administrative fee against the SWP3 bond; a third or subsequent violation triggers a Stop Work Order plus a $1,000 administrative fee against the bond. 14 lets the City Engineer suspend soil-disturbing activity for up to ninety days on notice. 99 makes any violation a third-degree misdemeanor punishable by a fine of not more than $500 or imprisonment of not more than sixty days, or both, with each day of continued noncompliance a separate offense. 04 was repealed by Ordinance 96-25 on May 12, 2025, when this standalone Chapter 1349 replaced it.
