Tyler requires an approved Erosion and Sediment Control Plan before any land-disturbing activity that needs grading. The plan must meet the Texas TPDES Construction General Permit (TXR150000). No grading permit issues without it, under UDC Sec. 10-526 and 10-527.
Tyler regulates erosion under UDC Article VI, Division E. Sec. 10-527 provides that no person is granted a land-disturbing permit requiring grading without the city's approval of an Erosion and Sedimentation Control Plan. Sec. 10-526 requires that plan, its design requirements, and inspections to comply with the State of Texas TPDES Permit TXR150000, the Construction General Permit covering sites that disturb one acre or more. Typical measures include silt fence, stabilized construction entrances, and sediment controls. The city reviews each application within ten working days and must respond in writing to approve, conditionally approve, or deny.
Grading or clearing without an approved erosion plan draws denial and a stop-work order. Chapter 10 UDC violations are punishable by fines up to $2,000 per day under Tyler Code Sec. 1-4.
