Summary

New and substantially improved buildings in Berkeley's mapped flood hazard zones must have their lowest floor built at or above the FEMA base flood elevation, the water level of the 100-year flood. Berkeley's code sets no additional freeboard margin above that federal benchmark.

1. Residential Construction. All new construction or substantial improvements of residential structures shall have the lowest floor, including basement: (a) In AE, AH, A1-A30 zones, elevated to or above the base flood elevation. (b) In an AO zone, elevated above the highest adjacent grade to a height equal to or exceeding the depth number specified in feet on the FIRM, or elevated at least two feet above the highest adjacent grade if no depth number is specified.

Full Breakdown

050 defines "base flood" as the flood with a one percent annual chance of being equaled or exceeded, also called the 100-year flood, and defines "base flood elevation" (BFE) as the water surface elevation shown for that event on the Flood Insurance Rate Map in Zones AE, AH, A1-A30, VE and V1-V30. 080. Nonresidential structures may instead be floodproofed watertight below that same elevation, with structural components able to resist hydrostatic and hydrodynamic loads, certified by a registered civil engineer or architect. 1 requires the lowest-floor elevation to be certified by a registered civil engineer or licensed land surveyor and verified by the city building inspector before that certification goes to the Floodplain Administrator.

4 directs the Floodplain Administrator to obtain and use base flood elevation and floodway data from FEMA, state, or other sources, including FEMA's approximate Zone A methodology, to set the required elevation.

Violations & Fines

A structure built in a special flood hazard area without the elevation certificate or floodproofing certification required by Section 17.12.090 is presumed in violation of Chapter 17.12 under Section 17.12.050's "Violation" definition until the owner produces that documentation. Non-compliance is a misdemeanor under Section 17.12.070, and the Floodplain Administrator maintains the elevation certifications on file for public inspection.

Frequently Asked Questions

How high above the flood level must a Berkeley home be built?
Section 17.12.090.C.1 requires the lowest floor, including any basement, of a new or substantially improved residential structure in an AE, AH, or A1-A30 zone to be elevated to or above the base flood elevation shown on the FEMA flood map for that zone.
Does Berkeley require extra freeboard above the base flood elevation?
No. Chapter 17.12 sets the lowest floor requirement at or above the base flood elevation itself; the code text does not add a freeboard margin above that federal benchmark for AE, AH, or A1-A30 zones.
Who certifies that a Berkeley building meets the flood elevation requirement?
Section 17.12.090.C.1 requires a registered civil engineer or licensed land surveyor to certify the lowest-floor elevation once construction is complete, and the city building inspector must verify it before the certification is filed with the Floodplain Administrator.
