Summary

Monroe Township, Middlesex County, sets its local design flood elevation at the best available flood hazard data plus one foot of freeboard for a delineated watercourse, or as N.J.A.C. 7:13 describes. Class IV critical facilities get two additional feet of freeboard, and Zone AO areas use the highest adjacent grade plus the FIRM depth number plus one foot.

A. The local design flood elevation (LDFE) is established in the flood hazard areas determined in § 44-11, above, using the best available flood hazard data sources, and the Flood Hazard Area Control Act minimum statewide elevation requirements for lowest floors in A, Coastal A, and V Zones, ASCE 24 requirements for critical facilities as specified by the Building Code, plus additional freeboard as specified by this chapter. B. At a minimum, the local design flood elevation shall be as follows: (1) For a delineated watercourse, the elevation associated with the best available flood hazard data area determined in § 44-11, above, plus one foot, or as described by N.J.A.C. 7:13, of freeboard; or ... (3) AO Zones. For Zone AO areas on the municipality's FIRM (or on preliminary flood elevation guidance from FEMA), the local design flood elevation is determined from the FIRM panel as the highest adjacent grade plus the depth number specified plus one foot of freeboard. If no depth number is specified, the local design flood elevation is three feet above the highest adjacent grade.

Full Breakdown

Section 44-12 sets the local design flood elevation, or LDFE, for every project in a flood hazard area. It starts from the best available flood hazard data, the Flood Hazard Area Control Act minimum statewide elevation requirements for lowest floors in A, Coastal A and V Zones, and ASCE 24 requirements for critical facilities, then adds freeboard. For a delineated watercourse the minimum is the elevation of the best available flood hazard data area plus one foot of freeboard, or as N.J.A.C. 7:13 describes. For an undelineated watercourse with a contributory drainage area of 50 acres or more, the applicant supplies either an unexpired NJDEP flood hazard area verification plus one foot of freeboard and any additional freeboard ASCE 24 requires, or a Method 5 or Method 6 determination under N.J.A.C. 7:13 plus the same freeboard, sealed and submitted under § 44-35A(3). Zone AO areas use the highest adjacent grade plus the depth number specified plus one foot, and three feet above the highest adjacent grade when no depth number is specified. Class IV critical facilities must meet the higher of the 0.2% annual chance (500-year) flood elevation or the flood hazard area design flood elevation with an additional two feet of freeboard, and Class III critical facilities in coastal high hazard areas get one additional foot.

Section 44-74 applies the LDFE: new construction and substantial improvement of a habitable building must have the lowest floor, including basement, and attendant utilities elevated to or above the LDFE and confirmed by an elevation certificate. Section 44-17 bars using changed base flood elevations until a CLOMR application is filed and FEMA approves, and § 44-19 lets the Floodplain Administrator require applicants to obtain data or have a licensed professional engineer determine the elevation when none is specified.

Violations & Fines

Violating Chapter 44 is punishable by a fine of not more than $1,250, imprisonment for up to 90 days, or community service for up to 90 days, and each day is a separate violation (§ 44-8). The owner gets a thirty-day period to cure and a court hearing before a larger fine can follow, and a repeat violation within one year draws an additional fine. The Floodplain Administrator can suspend or revoke a permit issued on incorrect information (§ 44-33).

Frequently Asked Questions

How much freeboard does Monroe Township require?
For a delineated watercourse the local design flood elevation is the best available flood hazard data elevation plus one foot of freeboard, or as N.J.A.C. 7:13 describes. Undelineated watercourses draining 50 acres or more also get one foot plus any additional freeboard ASCE 24 requires. Class IV critical facilities get an additional two feet of freeboard.
What is the elevation rule in an AO Zone?
For Zone AO areas on the FIRM, the LDFE is the highest adjacent grade plus the depth number specified plus one foot of freeboard. If the FIRM specifies no depth number, § 44-12 sets the local design flood elevation at three feet above the highest adjacent grade.
Where must the lowest floor of a new house sit?
Under § 44-74, new construction and substantial improvement of a habitable building in a flood hazard area must have the lowest floor, including basement, with attendant utilities elevated to or above the local design flood elevation from § 44-12, in conformance with ASCE Chapter 7, and confirmed by an elevation certificate.
What if no design flood elevation is mapped for my property?
Section 44-19 authorizes the Floodplain Administrator to require the applicant to obtain and reasonably use data from a federal, state or other source, or to determine the design flood elevation through hydrologic and hydraulic engineering analysis performed and sealed by a licensed professional engineer. The applicant is responsible for the accuracy of the data submitted.
