Summary

Tallahassee requires new and substantially improved residential structures in a mapped flood hazard area to sit at least two feet above the base flood elevation, a full foot of freeboard above FEMA's federal minimum, under Land Development Code § 6-62(1). Mechanical equipment must clear one foot above base flood elevation, and nonresidential buildings may floodproof instead of elevating.

Residential construction. New construction and substantial improvement of any residential structure shall have the lowest floor, including basement, elevated no lower than two feet above the base flood elevation. Should solid foundation perimeter walls be used to elevate a structure, openings sufficient to facilitate the unimpeded movements of floodwaters shall be provided in accordance with standards of subsection (3) of this section. All manufactured homes to be placed or substantially improved within zones A1-30, AH, and AE shall be elevated on a permanent foundation such that the lowest floor of the manufactured home is at least two feet above the base flood elevation and is securely anchored to an adequately anchored foundation system in accordance with the provisions of subsection 6-61(2). All equipment or mechanical items for new construction, and any substantial improvement of any residential structure or manufactured home, shall be at an elevation of at least one foot above the base flood elevation.

Full Breakdown

Section 6-62 applies wherever base flood elevation data have been provided under § 6-11. Residential construction and manufactured homes placed in zones A1-30, AH, and AE must have the lowest floor, including any basement, elevated at least two feet above the base flood elevation, with mechanical and electrical equipment set at least one foot above it. Nonresidential buildings get an alternative under § 6-62(2): they may be floodproofed to the same two-foot mark instead of elevated, but only if a registered professional engineer or architect certifies the design is watertight and can resist hydrostatic and hydrodynamic loads.

Any fully enclosed area below the base flood elevation, such as a garage under an elevated house, falls under § 6-62(3): it cannot be finished into living space, needs at least two flood vents totaling one square inch of opening per square foot of enclosed area with the lowest opening no higher than one foot above grade, and cannot carry electrical or plumbing connections. Elevation compliance is checked twice: § 6-32(b)(2) requires a registered surveyor's or engineer's certification of the as-built lowest-floor elevation at the framing inspection, and § 6-32(b)(3) requires a second certification at final completion, with work done before submission proceeding at the permit holder's own risk.

Violations & Fines

Failing to meet Chapter 6's elevation or floodproofing standards, or failing to submit the required elevation certifications, is cause for the building official to issue a stop-work order under § 6-32(b), and § 6-2 makes the underlying violation an offense punished under the general penalty, § 1-7: up to $500.00 in fines, up to 60 days in jail, or both, with each day of continued noncompliance a separate offense.

Frequently Asked Questions

How high above the flood line must I build a house in Tallahassee?
LDC § 6-62(1) requires the lowest floor, including any basement, of new or substantially improved residential construction to sit at least two feet above the base flood elevation, one foot more than FEMA's federal floor.
Can I floodproof a commercial building instead of elevating it?
Yes. Under § 6-62(2), nonresidential structures in A zones may be floodproofed to two feet above the base flood elevation instead of elevated, but a registered engineer or architect must certify the design meets the chapter's watertight and load standards.
Are enclosed areas below the flood elevation allowed?
Only if they cannot be finished as living space. Section 6-62(3) requires at least two flood vents totaling one square inch of opening per square foot of enclosed area, with no electrical or plumbing connections below the base flood elevation.
When do I have to prove my foundation meets the elevation rule?
Section 6-32(b)(2) requires a surveyor or engineer's certification of the as-built lowest-floor elevation at the framing inspection, and a second certification at completion under § 6-32(b)(3); missing either can trigger a stop-work order.
