Alexandria established the Stormwater Utility Fee as a dedicated funding source for stormwater management and Chesapeake Bay TMDL compliance. Numeric stormwater-quality mandates (nitrogen, phosphorous, sediment reductions) flow from the December 2010 EPA Bay TMDL and were first written into the City's 2013 MS4 permit. The City's Environmental Management Ordinance (1992) governs Chesapeake Bay Preservation Areas. Resource Protection Areas (RPAs), defined under Zoning Sec. 13-103(B) and further specified at Sec. 13-105, now require a 100-foot RPA buffer around all waterbodies with perennial flow. New development and redevelopment must implement stormwater quality best management practices (BMPs).
Disturbance within the 100-ft RPA buffer without authorization, or development without required BMPs, triggers the Virginia Erosion and Stormwater Management Program enforcement and potential restoration orders.
