Montebello, CA Environmental Rules: Stormwater Management (2026)

Chapter 8.36, the Storm Water and Urban Runoff Pollution Prevention ordinance, was adopted under the federal Clean Water Act, 33 U.S.C. Section 1251 et seq., to implement the city's NPDES municipal stormwater permit. Section 8.36.030 makes it unlawful for anyone to cause or allow an illicit discharge, or to dump, litter, or otherwise place pollutants like batteries, tires, yard debris, chemicals or animal waste where they can enter the municipal separate storm sewer system, and a violator can be billed for cleanup and remediation costs.

Section 8.36.040 separately bans maintaining or using an illicit connection to the storm drain system, giving the city manager or public works director authority to remove or disable one and recover the cost from its owner. Commercial and industrial facilities subject to state general permits must keep their notice of intent, waste discharge ID number and stormwater pollution prevention plan on site and produce them on request under Sections 8.36.070 through 8.36.100. The director of public works and city engineer, or their authorized representatives, may enter and inspect private property on twenty-four hours' notice to verify compliance, and can order an immediate cease-and-desist for an ongoing illicit discharge. New development and redevelopment projects above set size thresholds must also build in low-impact-development stormwater controls under Section 8.36.110, addressed as a separate requirement.
