Where this chapter's standards are more restrictive than another applicable ordinance or rule, § 258A-1D makes the more restrictive standard control.

Frequently Asked Questions

Does Passaic's stormwater ordinance apply to a small home renovation?
Generally no. Chapter 258A applies to "major development", nonresidential projects, plus only the aspects of residential major development not already preempted by the state's Residential Site Improvement Standards at N.J.A.C. 5:21, so small home projects typically fall outside it.
What design approach does Passaic require for stormwater on major projects?
§ 258A-1A directs the use of green infrastructure best management practices and low-impact development to maintain natural hydrology, reduce runoff volume and erosion, and encourage infiltration and groundwater recharge, based on each site's physical conditions.
What are the penalties for violating Passaic's stormwater ordinance?
§ 258A-12 sets a fine of up to $500 per day for a first offense and up to $1,000 per day, with possible imprisonment, for a second or subsequent offense.
Who enforces Chapter 258A in Passaic?
The Police Department, the City Engineer, the Department of Public Works, and Code Enforcement, per § 258A-13.
