A neighbor seeking to build or replace a shared fence must provide 30 days written notice to the adjoining owner describing the problem, proposed solution, estimated cost, timing, and sharing proposal. The notified neighbor can object and seek cost adjustment based on fairness factors including financial hardship, reasonableness of the design, and proportional benefit. Disputes that cannot be resolved informally go to small claims court (up to 12,500 dollars) or civil court. Civil Code section 841.4 separately prohibits spite fences over 10 feet built to annoy a neighbor. Elk Grove code enforcement does not handle civil fence cost disputes.
