Janesville, WI Fence Regulations: Fence Permit Requirements (2026)

Section 42-356(a) makes the general rule blunt: no person may cause or allow the installation, construction, erection, placement or replacement of a fence in the City of Janesville without first obtaining a fence permit. Five exceptions apply when every other provision of the fence chapter is met: fences under 16 feet in length being installed, repaired or replaced; underground electrical fences such as invisible pet fences; decorative fences of two feet or less in height in any district, provided they do not create a sidewalk hazard; temporary fences where otherwise permitted by the chapter; and chicken runs as defined in Section 8-70.

To apply, Section 42-356(b) requires a written application to the Building Division with a drawing, site plan or property survey showing property lines, adjoining streets, existing buildings and the proposed fence location. Section 42-356(c) requires payment of an application fee set by City Council resolution. Properties in a Historic Overlay District need a Certificate of Appropriateness under Section 42-356(d) before a fence permit can issue. Once issued, Section 42-356(l) gives the permit holder one year to complete installation; after that, no further work may occur until a new permit is obtained. Section 42-356(o) allows a permit denial, or approval with conditions, to be appealed to the Zoning Board of Appeals under Section 42-272.
