Clarkstown, NY Filming & Production: Location Permits (2026)

Chapter 139 of the Clarkstown Code, adopted in 2008, covers any movie, documentary, television program, commercial or similar production shot anywhere in town if money or anything of value changes hands for use of the property. " Applications go to the Town Clerk with a copy to the Town Attorney and must identify the applicant, the filming location, whether the applicant owns or leases the property, and who will actually be filming. Under § 139-3, the applicant must submit a plan covering days and hours of operation, parking, mitigation measures, and a 24-hour on-site contact responsible for the production.

The Chief of Police and Town Attorney can attach conditions on duration and hours, and the Chief of Police may require the production to pay for Town police officers at overtime CBA rates to cover public safety. Applicants must also furnish a hold-harmless agreement, an insurance certificate naming the Town as additional insured, and may be required to post a bond. Notably, § 139-3H specifies that Planning Board site plan approval is not required for a filming permit. Fees are set separately by Town Board resolution under § 139-4, charged per day for private property and per day for public property or parking use.
