Sec. 46-42 of the Wylie Code of Ordinances amends IFC § 307.4.1 so a bonfire cannot be conducted within 50 feet of a structure or combustible material, or a greater distance if the fire code official orders it, unless the fire is contained in a barbecue pit. A separate amendment, IFC § 307.4.4, sets a tighter 10-foot setback for a permanently installed outdoor firepit built for recreational fire purposes, reflecting the reduced risk of a securely constructed, permanent installation; an exception carries over for permanent outdoor fireplaces built to International Residential Code or International Building Code standards.

The Wylie Fire Prevention Division, a division of Wylie Fire Rescue headed by the Fire Marshal as fire code official under § 103.1, administers these setbacks. Building Inspections' Appendix A fee schedule lists a $150.00 permit fee for a site-built outdoor fireplace or fire pit with gas, and $50.00 for one built without gas. Under § 112.4, violating any provision of the fire code amendments in the City of Wylie is a misdemeanor punishable by a fine, with each calendar day of noncompliance charged as a separate violation; the fire code official may also order extinguishment under § 307.3. The Zoning Board of Adjustments, designated the fire code board of appeals under § 111.1, hears disputes over an official's setback determination.
