Wylie, TX Fire Regulations: Outdoor Burning (2026)

Wylie's open-burning rules come from the 2021 International Fire Code as locally amended in Sec. 46-42, not a separate city ordinance. Section 307.1.1, as amended, prohibits open burning that is offensive or objectionable because of smoke emissions, or when atmospheric conditions or local circumstances make the fire hazardous, giving the fire code official broad authority to shut down a burn based on smoke or weather alone. Section 307.2 requires a permit from the fire code official under Section 105.6 before kindling a fire for silvicultural, range or wildlife management practices, disease or pest control, or open burning generally, and that permit can only be applied for and issued to the landowner where the fire will be kindled.

Section 307.3, as amended, lets the fire code official order the permit holder, another responsible person, or the fire department to extinguish a burn that becomes hazardous or objectionable. Section 307.4, as amended, sets a 300-foot setback: the burn location must be at least 300 feet from any structure, with provisions in place to keep the fire from spreading within 300 feet of a structure. The amendment package notes that county or TCEQ burn bans and local written fire-official policies can further restrict or suspend burning on top of these code requirements, so a Collin County burn ban imposed during dry conditions overrides any local permit already issued. Violations of the fire code, including unpermitted or hazardous open burning, are enforced by the Wylie fire marshal.
