The City of Alameda prohibits consumer fireworks entirely. Under the Alameda Municipal Code (Chapter IV, Offenses and Public Safety, Article V, Firearms and Explosives), it is unlawful for any person to fire, discharge, or set off any fireworks in the City, or cause or allow the same to be done, except for public exhibitions of fireworks displayed under the control or authority of the City Council. State law backs this up: California Health and Safety Code Sections 12500-12728 govern fireworks statewide, classifying them as 'dangerous fireworks' (HSC 12505) or 'safe-and-sane' (HSC 12529). Because Alameda has not adopted an ordinance permitting safe-and-sane fireworks, even those approved by the State Fire Marshal cannot be possessed or used in the city. HSC Section 12677 prohibits possessing dangerous fireworks without a valid permit. Local violations are enforced by the Alameda Police Department and Alameda Fire Department; possession or discharge can lead to seizure, citation, and criminal liability.
Discharging or setting off fireworks in Alameda is a violation of the Municipal Code. Violators face citation, seizure of the fireworks, and possible criminal penalties; under the applicable code section, violations are generally chargeable as an infraction (fine up to $250) or a misdemeanor (fine up to $1,000 and/or up to six months in county jail). State penalties under the Health and Safety Code may also apply.
