Ashwaubenon, WI Fire Regulations: Fireworks (2026)

Ashwaubenon Municipal Code Section 9-1-4 defines fireworks broadly but excludes items such as fuel, flares, matches, novelty caps, tobacco products, sparklers on a stick no longer than 36 inches, and small novelty poppers and snakes, so those remain legal without a permit. Beyond those exclusions, subsection (B) makes it unlawful to possess, use, sell or possess with intent to sell fireworks anywhere in the Village. A public pyrotechnic display is only lawful with a permit from the Village's Director of Public Safety: the application must be filed at least 15 days before the event, name the permit holder, list the kind and quantity of fireworks and the date and location, include a site plan, and pay a fee on file at the Village Clerk's office (waivable for nonprofits by the Chief of Public Safety).

The operator must be a competent adult, the Fire Inspector gets a detailed listing of the fireworks and may require a demonstration, and the permittee must carry at least $1,000,000 in combined liability insurance naming the Village as an additional insured, with 30 days' notice before any cancellation. Retail sellers of Class C fireworks need a separate annual permit, applied for 30 days in advance with a $500 fee, one per sales location, and may not let minors sell or handle stock unsupervised. Storage rules bar keeping fireworks within 50 feet of a dwelling or within 50 feet of a public gathering or place dispensing more than a gallon of gasoline, require fire extinguishers on wholesale premises, and forbid smoking within 50 feet of stored fireworks.

A parent who consents to a minor's fireworks use is liable for resulting damage. The Chief of Public Safety may seize fireworks involved in any violation at the owner's expense.
