Burlington, WI Fire Regulations: Fireworks (2026)

Section 155-39 of the Code of the City of Burlington tracks the state fireworks statute but layers on its own permitting machinery. 10(2) and (4), Wis. , allow. Possessing, manufacturing, using, displaying or discharging fireworks without a permit is likewise unlawful. A user's permit to display or discharge fireworks is issued by the Mayor for festivals or celebrations; the applicant gets the form from the Fire Department, must file at least seven days before the event, and cannot accumulate or buy fireworks before the permit is issued.

The Authority Having Jurisdiction inspects the site and reviews the application, granting or denying the permit at its discretion with public safety and neighboring property in mind, and may reinspect the display and landing sites at any time, using NFPA 1123 and 1124 as inspection guides. Every applicant must carry $1,000,000 in liability insurance and hand over any contract with the company running the display or storing the fireworks. Display companies must return within 18 hours, during daylight, to search for and dispose of unexploded fireworks, and City police or fire personnel can expand that search area.

Separate permits from the AHJ cover fireworks manufacture or storage the Plan Commission has approved under § 315-31 or § 315-33. Unlicensed use of caps or sparklers in a City park, or at a permitted public display, is barred, and no parent or guardian may knowingly let a minor violate the section.
