Fitchburg, WI Fire Regulations: Fireworks (2026)

Section 44-692 states that the city elects, under Wis. 10(5), to regulate the sale, possession, and use of fireworks, and section 44-693 adopts the rest of Wis. 10 by reference, excluding its penalty provision, which the city replaces with its own. Section 44-695 then bans the core conduct directly: no person may sell fireworks, possess fireworks with intent to sell, or use fireworks except as allowed in the article. Section 44-696 exempts only a short list of activities, including explosives and blasting agents used lawfully in construction or mining, blank cartridges for theatrical or signal use, and, distinctively, pyrotechnic displays approved by the Fitchburg Days Committee for a Fitchburg Days event and displays approved by the public safety and human services committee for the annual Festa Italia event sponsored by the Italian Workman's Club.

Storage rules in section 44-698 require fireworks to be kept away from smoking, at least 50 feet from a dwelling, and at least 50 feet from a public assemblage or place dispensing more than a gallon of gasoline or volatile liquid, with fire extinguishers approved by the fire chief on site. Section 44-699 makes a parent, foster parent, or guardian who consents to a minor's use of fireworks liable for resulting damages, on top of the standard code penalty. 00 in bodily injury and property damage insurance.
