Idaho Code Title 39, Chapter 26 (the Fireworks Act of 1997) governs statewide. 'Nonaerial common fireworks' must stay within a 15-foot circle and not throw sparks beyond a 20-foot circle or above 20 feet, and expressly exclude firecrackers and jumping jacks. Aerial or audible fireworks may only be used under a public-display permit issued by the authority having jurisdiction (fire district or, in unincorporated Ada County, the county commission). Consumers may buy and use legal fireworks June 23-July 5 and December 26-January 1. Selling or using illegal fireworks, or burning where fire danger is severe, is prohibited.

Violations & Fines

Selling or using fireworks when not permitted is an infraction with a $100 fine (Idaho Code 39-2609). Other violations are misdemeanors; fireworks may be confiscated.
