Margate, FL Fire Regulations: Fireworks (2026)

Margate's Code approaches fireworks from two chapters. Chapter 15 (Fire Protection), Section 15-14, requires an inspection before permits issue for the keeping, storage, use, manufacture, sale, handling or other disposition of explosives of any kind, including fireworks, sparklers and signaling explosives. The fire marshal or his assistant must inspect and approve the receptacles, vehicles, buildings or storage places and the point of sale or distribution. Where other departments or agencies enforce their own rules, joint approval is required from all of them. Section 15-14(5) then lists the permits required as specified in the Florida Fire Prevention Code, and fireworks are item d, right after explosives.

Under Section 15-14(1) a permit is not transferable, and any change in use or occupancy of the premises requires a new permit. Applications go to the bureau of fire prevention under subsection (2), with whatever plan the fire chief or fire code official requires. Under subsection (3) the permit stays on the premises at all times and is open to inspection by any officer of the fire, police, code enforcement or building departments. Chapter 33, Section 33-79(i), sits inside the Noise Control Code and declares the using of fireworks, explosives or other explosive devices without first obtaining a permit to be loud, disturbing and excessive noise in violation of that code.

The Margate Police Department administers that article under Section 33-77. The sections quoted here do not set out a standard for when a permit is granted, so the permit itself is the gate.
