Idaho Code 39-2601 et seq. limits consumer fireworks to non-aerial, non-explosive devices, regulates licensed sales windows, and treats illegal aerial fireworks as a misdemeanor offense statewide.
Under Idaho Code 39-2601 through 39-2606, only non-aerial and non-explosive common fireworks may be sold to the public, while aerial devices like bottle rockets, Roman candles, and firecrackers are illegal for general sale and use. Wholesalers and retailers must obtain licenses from the State Fire Marshal, and retail sales are limited to June 23 through July 5 and December 26 through January 1. Buyers signing an affidavit promising to discharge fireworks only outside Idaho may purchase otherwise prohibited fireworks at licensed stands, but possession or use of those devices inside Idaho remains illegal.
Possessing or using illegal fireworks is a misdemeanor punishable by up to six months jail and $1,000 fines under Idaho Code 39-2606.
