Sauk County, WI Fire Regulations: Fireworks (2026)

Sec. 11.14, adopted under authority granted by Wis. Stats. Sections 59.54(6) and 167.10(5), imports the state's fireworks definition from Wis. Stats. Section 167.10(1) by reference rather than writing its own. Subsection (3) bars anyone from selling, or possessing with intent to sell, fireworks except as Wis. Stats. Sections 167.10(2) and (4) allow, and subsection (4) bars possessing or using fireworks except as Wis. Stats. Section 167.10(3) allows. Subsection (5) goes further than the sale-and-use ban: even where state law would otherwise permit a display, no one is allowed to use the higher-hazard devices listed in Wis.

Stats. Sections 167.10(1)(e) to (g) and (i) to (n), or the (3) exception itself, if the display is open to the general public, closing off backyard-style public displays of the larger devices. The ordinance covers every unincorporated area of the county and, under (6)(a), also reaches any incorporated city or village in Sauk County that has not passed its own fireworks ordinance, so towns without a local rule fall under this county standard by default. The Sauk County Sheriff's Department or its designee enforces the section, the County can ask the Circuit Court for an injunction against ongoing violations under (6)(c), and (6)(d) requires any fireworks connected to a violation to be seized, then destroyed after conviction or returned to the owner if the case does not result in a conviction.
