Smyrna, GA Fire Regulations: Fireworks (2026)

Two sections govern. Section 50-8, adopted by Ord. No. 2021-07 on May 3, 2021, sets hours: on December 31, fireworks can be ignited from 10:00 a.m. up to and including an ending time of 1:00 a.m. on January 1, and on all other days it is unlawful to ignite fireworks between 12:00 midnight and 9:59 a.m.

Section 50-8.1 adds the permit layer. Anyone who wants to use consumer fireworks on a day other than those allowed by O.C.G.A. § 25-10-2(b)(3)(B)(ii) and (iii) must obtain a special use fireworks permit. Subsection (a) frames the window as 10:00 a.m. to 11:59 p.m., while subsection (c) states 9:00 a.m. to 11:59 p.m. The permit comes from the fire marshal, and applications are submitted electronically through the permit application system of the city. The applicant pays for the permit at the price fixed by the Mayor and Council, and the permit is valid only for the dates, times and locations approved.

Fireworks in any park, historic site, recreational area or other property owned or operated by, for, or under the custody and control of the city need written permission from the city administrator or designee, on top of the special use permit. Consumer fireworks must be used in accordance with their affixed caution and warning labels and with all applicable local, state and federal laws.

Subsection (h) sets a signage rule for licensed distributors: each retail display area for consumer fireworks needs at least one sign, at least 22 inches by 28 inches, printed in at least 40 point boldface type in a color contrasting with the background, kept free from obstruction and in plain sight of customers. It carries three messages: check local ordinances before using fireworks, use them in accordance with their labels, and be a good neighbor because unannounced ignition can be traumatic for some military veterans, other persons and pets.
