Stonecrest, GA Fire Regulations: Fireworks (2026)

Chapter 12's Article VII, Fireworks, opens with definitions in Sec. 12-176 that track the state's terms in O.C.G.A. § 25-10-1 et seq. and expressly defer to the state definitions where the two conflict. Sec. 12-177 then bars the core activity within city limits: offering consumer fireworks or fireworks for sale at retail or wholesale, using or exploding them or causing them to be exploded, and possessing, manufacturing or storing them, all unlawful except as permitted under state law or elsewhere in the article. That 'except as permitted under state law' clause matters because Georgia's own fireworks law sets statewide sale and use windows; Stonecrest's ordinance folds those state allowances in rather than overriding them outright, while still writing a broad local restriction on top.

The one carve-out the article spells out itself is Sec. 12-178, public exhibitions or displays of fireworks, which are allowed if properly permitted under O.C.G.A. Title 25, Chapter 10, the state fireworks act; an unpermitted public display would not qualify for that exception and would fall back under the Sec. 12-177 ban. The definitions section also excludes several items from 'fireworks' and 'consumer fireworks' outright: model rockets and rocket engines, toy pistol paper caps averaging 0.25 grains or less of explosive mixture, wire or wood sparklers of 100 grams or less per item, and other listed novelty items such as snakes, glow worms, smoke devices and trick noisemakers, none of which trigger the sale, use, possession, manufacture or storage ban.
