Under Westminster Municipal Code Chapter 9.66 (Fireworks Stands—Sale and Discharge of Fireworks), only fireworks bearing the California State Fire Marshal seal may be sold or used. Fireworks may be sold only from permitted stands June 30 through July 4 (typically 10 a.m.–10 p.m., with shorter hours July 4). Discharge is restricted to July 4th, generally 10 a.m. to 10 p.m. No person may discharge a "Safe and Sane" firework within ten feet of any residence, dwelling, or other structure. Fireworks may be used on residential streets, but not on arterial streets or on public property. No person under the age of 16 may purchase fireworks, and minors may not discharge them without an adult present. Any firework that leaves the ground or explodes—bottle rockets, mortars, aerial shells, cherry bombs, M-80s, and firecrackers—is illegal regardless of where purchased. This contrasts with California Health and Safety Code section 12500 et seq., which classifies such items as "dangerous fireworks."
Possession, sale, or discharge of illegal (non-"Safe and Sane") fireworks is subject to a $1,000 administrative fine in Westminster. Misuse of legal fireworks (wrong dates, public property, arterial streets, within ten feet of a structure) is also a code violation. Report illegal fireworks to Westminster Police Department.
