Piscataway, NJ Fire Regulations: Outdoor Burning (2026)

Section 10-12.1a prohibits burning any material, solid or liquid, out-of-doors anywhere in the Township, expressly naming household waste as covered, unless an exception in subsection b applies. Those exceptions are narrow: ceremonial fires run by a recognized not-for-profit social, cultural, or religious organization; ceremonial flag retirements; training burns organized by a Township Fire Company, whether or not held at the Fire Training Facility; fires organized by the Department of Public Works for a public purpose; fires in an outdoor fireplace, lined fire pit, or chimenia; grills burning charcoal, seasoned dry wood, natural gas, or LP gas for cooking or heating; Township-organized fireworks displays; any other fire the Township Fire Official approves at his or her discretion with appropriate safeguards; and fireworks otherwise permitted under Title 21, § 3-2 of the New Jersey statutes.

Section 10-12.2 requires every permitted fire, even one that fits an exception, to still comply with all applicable state and Middlesex County rules, specifically naming the Smoke Control Code of New Jersey and the Air Pollution Control Code that the Township itself has separately adopted. Section 10-12.3 ties the penalty for violating the base prohibition in § 10-12.1a to the Code's General Penalty at § 1-5, which sets a maximum of imprisonment up to 90 days, a fine up to $2,000, or community service up to 90 days for an ordinary violation, and § 1-5.7 treats each day a violation continues as a separate offense.
