Outdoor burning rules in San Clemente, CA — also called the burn ban, open burning, or fire restriction ordinance — set when you can burn yard waste, debris, or run a recreational fire.
Open burning of rubbish and yard waste is effectively prohibited in San Clemente. Adopted Fire Code Section 307 (SCMC Chapter 8.16) limits outdoor fires to small controlled fires and requires trash to be burned only in an approved incinerator. OCFA and South Coast AQMD regulate any burning.
SCMC 8.16.050 adopts California Fire Code Section 307. Added Section 305.7 requires rubbish, trash, or combustible waste to be burned only in an approved incinerator per Section 307.2.1. Section 305.6 bars solid-fuel outdoor fires when winds exceed 8 mph with humidity below 25%, on Red Flag days, or when a ban is posted; no fire of any fuel above 20 mph winds. Added Section 307.7 prohibits kindling any fire in the public right-of-way, on City property, on land zoned Open Space, Public, Civic Center, or Institutional, or on vacant land zoned Inland Canyon, Coastal Canyon, or Coastal Bluff. San Clemente's semi-arid climate, Santa Ana winds up to 70 mph, and canyon fuels make open burning a wildfire risk.
Illegal open burning violates SCMC Chapter 8.16 and may violate South Coast AQMD rules. OCFA, the Sheriff's Department, and City enforcement personnel may order extinguishment and cite per the OCFA fee schedule.
