San Clemente adopts the 2025 California Fire Code as SCMC Chapter 8.16 (Ordinance No. 1796, effective January 1, 2026), enforced by OCFA (SCMC 8.16.020). California Health & Safety Code sections 12500 et seq. let cities ban even 'safe and sane' fireworks the state otherwise permits. San Clemente has never authorized retail sale or discharge, so all fireworks are prohibited citywide, and fireworks are also expressly banned on all City beaches. Under adopted Fire Code Chapter 56 (SCMC 8.16.105, Sections 5608.2-5608.3), permitted display fireworks must be electrically fired, with an OCFA permit application showing the ground diagram and a fallout area of 100 feet per inch of shell size.
Discharging, selling, or possessing fireworks in San Clemente is unlawful. OCFA, the Sheriff's Department, and City Code Compliance may cite violators, confiscate fireworks, and hold anyone who starts a fire liable for suppression costs.
